THE QUESTIONS AND THE ANSWERS


1.    Is there a limit to the number of times I can use a form?

No.  When you purchase a Kanes Forms Program, the License Agreement allows you to use all the forms as many times as you wish.

2.    What happened to “Know All Men by These Presents”?

In the last twenty (20) years we’ve never been able to find anyone to explain the significance this phrase has in today’s documents, and have never included the phrase in any of the Kanes’ forms.  In addition to eliminating this phrase, the forms in the Kanes Forms Programs are written in plain English, with as much legalese eliminated as possible.  This makes the forms easier to read and understood.

3.    Who prepared the forms in the Kanes Forms Programs?

The forms in the Kanes Forms Programs are written and compiled by Mike Atnipp and Doug Atnipp, the principals of Kanes Forms.  Information about them and their qualifications can be found at “About/Contact Us.”

4.    Are there different forms in each of the Kanes Forms Programs?

Yes.  While all the forms in each of the Kanes Forms Programs are not different, most forms in each Program are not in the other Programs.  For a list of all the forms in each Program, look at “Master Index and Sample Forms.”  On the pull down menu that will appear, select the name of a Program.  You will see an Index of all forms in that Program.  


5.    Are the Kanes Forms Programs available in a network version?

No.  Currently the Forms are available as single user license.  To inquire about a network version please contact KANES Forms directly to determine if there is a product we have to fit your needs.

6.    What methods of payment are accepted to purchase a Kanes Forms Program?

You may pay for the Program you purchase by check, money order, or credit card.  MasterCard, Visa, Discover, and American Express are accepted.

7.    How do I order a Kanes Forms Program?

On the Menu Bar at the top of the page click on “Price/Order.”  You may then click on the method you wish to use to order one or more of the Kanes Forms Programs by mail, phone, fax, or online.

8.    Can I revise the forms in the Kanes Forms Programs to meet my particular needs?

Absolutely yes.  All the forms in the Kanes Forms Program are in text form that can be edited, revised, added to, and amended any way you wish, so that the document you prepare will meet your specific transaction needs.

9.    Can the forms be used in all states?

Yes.  The only forms that are state specific are the lease forms.  All other forms can be adapted for use in any state.

10.    How soon after I place my order will I receive my Program(s)?

The Program(s) you order will be shipped with 2 – 3 business days after your paid order is received.  Most orders received by 3:00 p.m., Central Time, with payment, are shipped the day they are received.  All orders received by Kanes Forms in Midland, Texas, are shipped directly from that office.  The regular method of shipment is by U. S. Postal Service Priority Mail, providing for 2 – 3 day delivery in the continental United States.  If overnight deliver is requested, it is available by UPS Next Day Air, with the cost of this special delivery being paid by the customer.

11.    What word processing program is needed to use the forms on my computer?

The Kanes Forms Programs work with any version of any word processing program.  You must have a word processing program on your computer to make full use of the forms.  When you save a form, you have the option of doing so in Microsoft Word, or if you use another word processing program (such as WordPerfect), you may save forms in RTF (Rich Text Format).


12.    How long does it take to learn to use one of the Kanes Forms Programs?

Maybe up to 5 minutes!  There is no new program to learn to make full use of the Kanes Forms Program.  You must be able to use the word processing program on your computer to make full use of the forms in the Kanes Forms Programs.

13.    Can I purchase a single form?

Kanes Forms does not sell individual forms.  Many of the forms in the Kanes Forms Programs have been licensed to, and may be purchased individually, from US Legal Forms.  The website address is www.uslegalforms.com.

14.    Are the Kanes Forms Programs Guaranteed?

Yes.  If, for any reason, during the first six (6) months after you purchase a Kanes Forms Program you are not satisfied with your purchase, return it to Kanes Forms and the price you paid for the Program will be refunded in full (less shipping and handling).  No questions asked.  In addition to this money back guarantee, if the Program CD or memory stick is found to be defective (doesn’t work for any reason), return it to Kanes Forms.  We will replace the Program you purchased, at no charge.

This guarantee does not cover lost or stolen Programs.  (You would not believe how many calls we get about this!)  If you break your CD or memory stick – there is a replacement fee charge.

15.    Why don’t the forms have the “legalese” I’m accustom to seeing in documents?

In preparing the forms in the Kanes Forms Programs, a diligent effort was made to eliminate much of the “legalese” from the documents, and write them in plain English.  Eliminating “whereas,” “heretofore,” “witnesseth,” etc. does not change the legal effect or meaning of the text of the forms.  It does make them easier to read, and easier to understand.

16.    Can I duplicate the Kanes Forms Program?

No.  The Kanes Forms License Agreement does not permit you to duplicate or “burn” the Kanes Forms Program to create an additional copy.  We have made significant efforts to provide many useful forms, at a very reasonable price.  To do so we have minimized the security systems in the Program, to allow you to run the Program on several computers, as long as you have the Program CD or memory stick available.  We recognize the occurrence of software piracy, in general, is very prevalent.  By limiting the security systems in the Kanes Forms Programs, we open ourselves up to that risk.  However, to accommodate the majority of our customers, we’ve kept the Programs simple, trusting them not to duplicate the disk for the benefit of unlicensed users.

17.    What if I can’t use a word processing program?

To make full use of all the Kane Forms Program, you will need to be able to use a word processing program.

18.    What if I don’t’ like the way the forms are formatted?

You can change the format of any of the forms (font type, size, margins) to meet your particular preference.  While the format of many of the forms, in setting out the name of the Grantor, Grantee, Effective Date, etc., in subheadings, was new for some in 1989, it has been well received and is now used by many Kanes Forms customers.  There are some who prefer a more traditional format that sets out this information in narrative form.  That is easily accomplished by modifying any of the forms to adapt them to the style you prefer.  

19.    How does the license agreement for the Kanes Forms Program allow me to use the forms?

The Kanes Forms License Agreement allows you to use all the forms as many times as you want, and install the Program on any computer.  The License Agreement does not allow you to duplicate, “burn,” or copy the Program or to sell the forms as your own.  To see the complete License Agreement, see “Tech and Legal Stuff.”  

20.    Are the forms available in a book or print form?

No.  Kanes Forms no longer publishes the forms in a print version.

21.    How do the Kanes Forms Program work?

All of the Kanes Forms Programs work the same way.  For a complete description of how the Kanes Forms Programs work, click on “Tech and Legal Stuff,” and see “How the Programs Work.”

22.    Do the Programs have instruction manuals that will show me how to use them?

Each Program is accompanied by instructions on how to install the Program on your computer.  Because there is no new program to learn, there is no “instruction manual.”  When you open the Program, you will find information on how to use the Program, called “Tips.”  This page describes the simple instructions of the Program on how to locate, view, save, or copy a form.  If you need more information or assistance, you can always call Kanes Forms, toll free, at 1-800-526-3790.

23.    What do the forms look like?

Click on Program Index & Sample Forms Menu Tab, from the drop down menu select the Forms Progam you would like to explore.  The Program Index is a complete list of all of the Forms available.  We provide a sample of each form to view online.  The Sample Forms include the First Page Only online.

24.    I need a form immediately.  Do I have to wait until the Program is sent to me?

No.  We often receive orders for a Program, and the customer needs one or two forms immediately for a project.  When your order is received, if you need a particular form immediately (and can’t wait until the Program is delivered to you), we will be happy to send you the particular form you request as an email attachment.

25.    Is it difficult or time consuming to install a Kanes Forms Program on my computer?

No.  Once you insert a Kanes Forms Program disk in the CD drive of your computer, or plug in the memory stick in a USB port, the installation process should begin.  To complete the installation process, follow the directions on the screen.  If the Program does not install automatically, the Program is delivered with simple installation instructions to follow, or you can always call Kanes Forms at 1-800-526-3790.

26.    Can I install the Kanes Forms Program on more than one computer?

Yes.  The Kanes Forms License Agreement allows you to install the Program you purchase on any computer.

27.    Does the Kanes Forms License Agreement allow more than one person to use the Program?

Yes.  One of the better ways we’ve found to describe how a Program can be used is to compare it to a library book.  The operating functions of any of the Kanes Forms Programs can be loaded on any computer.  The Program CD or memory stick must be installed in that computer to access the forms on the Program.  This enables multiple parties to use the Program, but only one at a time.

28.    Is there a reduced price if I purchase more than one of the Kanes Forms Programs?

Yes.  “Combination Programs” are available.

29.    Does Kanes Forms provide 24/7 live technical service and support?

No.  “Live” technical support is available Monday through Friday during normal business hours (Central Time).  If you call after those times, leave us a message and we will return your call the next business day.  The Kanes Forms Programs are so simple to install and use, there is very little need for technical assistance.

30.    Can I place an order after regular business hours?

Yes.  Fax and online orders are received 24/7.  If you wish to order by phone, the toll free 800 number for Kanes is answered Monday through Friday, during normal business hours (Central Time).  At all other times, you may leave a message and your call will be returned the next business day, to take your order.

31.    Where is Kanes Forms located?

Midland, Texas.

32.    I haven’t heard of Kanes Forms, why?

Kanes Forms has been providing forms for use in oil and gas transactions since 1989, but has not engaged in a great deal of commercial advertising, primarily to hold down costs and pass the savings on to our customers.  

33.    Are the forms in the Kanes Forms Program intended to provide legal advice?

No.  While the forms are written and edited by attorneys, they are not intended to provide or be a substitute for legal advice.  As specified in the License Agreement, they are intended to be used by those with experience in drafting oil/gas/energy transaction documents, with, or in conjunction with, advice from experienced practitioners.

34.    What are “Combination Programs?”

Combination Programs are multiple Kanes Forms Programs on 1 USB Stick.  Combination Programs provide greater convenience and savings for those ordering more than 1 of the Kanes Forms Programs.
